Acceptable Use Policy
Last updated: October 20, 2026
1. Scope
This Acceptable Use Policy (“Policy”) applies to everything you create, submit, or upload through MakerNice, including the console, the model playgrounds on makernice.com, and the API (api.makernice.com). It is part of our Terms of Service.
If you use the API to offer generation features to your own users, you are responsible for making sure their prompts, uploads, and outputs also comply with this Policy.
You must also comply with the usage policies of the upstream model providers whose models you use through MakerNice.
All images and videos produced through MakerNice are generated by AI models. Do not present AI-generated content as real footage, real photographs, or human-made work where that would mislead people.
2. Prohibited Content
You must not use MakerNice to generate, upload, or distribute content in any of the following categories:
- Pornography and sexually explicit content (NSFW). Any nudity or sexually explicit material, including sexualized depictions of real or fictional people.
- Violence and gore. Graphic violence, gore, torture, self-harm, or content that glorifies or incites violence, terrorism, or mass harm.
- Hate speech. Content that attacks, demeans, or incites hatred against people based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, age, or other protected characteristics.
- Child-unsafe content. Any content that sexualizes, exploits, or endangers minors, including child sexual abuse material (CSAM) of any kind, real or synthetic. This is zero tolerance.
- Deepfakes and impersonation. Content that replaces or disguises a real person’s identity or face, places real people in fabricated scenes, or impersonates a real person or organization. See Section 3.
- Copyright and trademark infringement. Content that copies or imitates protected works, characters, logos, or brands without permission from the rights holder.
You must also not use MakerNice to:
- Engage in or promote illegal activity.
- Harass, threaten, bully, or defame anyone.
- Commit fraud, phishing, or scams, or spread disinformation.
- Create or distribute malware or other harmful code.
- Promote, encourage, or give instructions for self-harm, suicide, or eating disorders.
- Support terrorism or violent extremism, or help develop, acquire, or use weapons of mass destruction, including chemical, biological, radiological, or nuclear weapons.
- Create or share intimate or sexual images or videos of a real person without that person’s consent, including non-consensual sexual deepfakes.
- Send spam, or generate content in bulk to deceive or manipulate people or platforms.
- Violate anyone’s privacy, for example by collecting, exposing, or tracking personal information without consent.
- Bypass, disable, jailbreak, or test the limits of our moderation or any other safety system, for example by disguising prohibited requests.
Zero tolerance: child sexual abuse material (CSAM), terrorist content, and non-consensual sexual deepfakes of real people. For these, we terminate the account directly, without a prior warning, and report the matter to law enforcement where the law requires it.
3. Uploaded Images of Real People
Some generation modes let you upload images, such as a first frame or reference images. You may only upload images that you own or that you have permission to use. You must not upload photos of another person without their consent.
Even with consent, you must not use MakerNice for any of the following:
- Face swaps: putting one real person’s face onto another person.
- “Nudify” or undressing real people in any image or video.
- Placing two real people together in a kissing, hugging, or other intimate scene.
- Making a real person appear to say or do something they never said or did.
4. How We Moderate Content
Every generation request passes platform-side moderation before and after the model runs:
- Before generation: each prompt is checked against our blocklist of prohibited terms, which we review and update regularly, and is then scanned by automated content moderation services (including Prompt Sift and other third-party moderation services); it is blocked if any of them flags it. A blocked prompt is never sent to a model and you are not charged. A prompt flagged for review is held until the review completes, for up to about one hour; if no decision is reached, it is cancelled and refunded. Reference images you upload or link are scanned by the OpenAI Moderation API before generation as well; a request with a rejected image is not generated and is refunded. If a model provider’s own safety system rejects a request, it is also refunded.
- After generation, before display: every image, and frames sampled from every video, are scanned by the OpenAI Moderation API before the result is shown to you or delivered through the API or webhooks. A result that fails is withheld; you can contact us to have it reviewed by a person, and we respond within 2 business days.
- Child safety: a prompt flagged as child-unsafe content freezes the account automatically, and we then handle it as a Level 1 violation under section 5.
- Records: we keep a record of every automated moderation decision and every human review decision.
No automated system is perfect. Moderation does not shift responsibility for your prompts and outputs away from you.
5. Severity Levels
We classify violations by severity and handle them as follows:
- Level 1 – Critical: child-unsafe content, terrorist content, a non-consensual sexual deepfake, or a deepfake of a real person that is actively spreading. We act within 24 hours of becoming aware of it by freezing the account, and we complete our handling within 72 hours, including reporting the matter to law enforcement where the law requires it. Zero-tolerance violations listed in Section 2 end in termination of the account.
- Level 2 – Serious: any other category in Section 2. After human review, we disable the API keys involved or freeze the account. We complete our handling within 7 business days.
- Level 3 – Minor or unclear: borderline cases or first-time issues. We send a warning by email. We complete our handling within 15 business days.
- Level 4 – No violation: no action is taken, and we reply to the person who reported it.
If a case takes longer than these timeframes, we let the person who reported it know.
6. Reporting Violations
If you see content generated through MakerNice that violates this Policy, email support@makernice.com with the subject line Content Report. Please include:
- A link to, or a screenshot of, the content.
- The generation ID or the account email involved, if you know it.
- Which category of this Policy you believe it violates.
We acknowledge every report within two (2) business days. Each report is classified by severity, reviewed by a person, acted on according to Section 5, and we let you know the outcome.
We keep the identity of the person who reported it confidential and do not share it with the reported user, unless the law requires us to. Knowingly false or malicious reports are themselves a violation of this Policy.
7. Enforcement
Depending on severity, we may take one or more of the following actions:
- Send a warning by email.
- Disable one or more of your API keys.
- Freeze your account, which stops all new generations.
- Terminate your account.
- Report the violation to law enforcement where the law requires it.
Repeated or deliberate violations escalate: from an email warning, to disabling API keys, to freezing the account, and finally to termination. While we investigate a possible violation, we may freeze the account first.
8. Appeals
If you believe we acted on your account by mistake, email support@makernice.com with the subject line Appeal within 30 days of our notice. Include your account email, the generation ID or IDs involved, and an explanation of why. We will review the decision again and reply with the outcome by email.
Terminations for the zero-tolerance violations listed in Section 2 cannot be appealed.
9. Changes to This Policy
We may update this Policy from time to time. The version posted on this page applies, and the “Last updated” date on this page shows when it last changed. If we make a material change, we will notify you by email.
